The Collaborative divorce process is an alternative dispute resolution process whereby both parties and their attorneys commit themselves to resolving their differences justly and equitably without resort or threat of resort to litigation.It is a process that relies on an atmosphere of honesty, cooperation, integrity and professionalism whereby the parties and their attorneys engage in informal discussions and conferences to settle all issues, called "four-way meetings."
Collaborative law is a process that requires each party and their attorney to take a reasoned position on all issues and to use interest-based negotiations. When differences arise, all participants (the parties and their attorneys) use their best efforts to create proposals that meet the fundamental interests of both parties. The collaborative divorce process benefits parties because it is quicker than traditional litigation methods of divorce and the parties create an agreement specifically tailored to meet their needs.
Collaborative divorce advantages are that everyone engaged in the process is committed to work toward settlement (litigation is not threatened and game-playing strategies are not employed); the process is private; the parties control the length of time and the expenses incurred; and the parties can share professional expert advisors, as needed.
