Annulment is a legal process by which the Court declares a marriage to be a nullity. In other words, the Court sets aside the marriage as though it never existed.
In Oklahoma, legal grounds for annulment have to do with the capacity of the parties to enter into the marriage. For example, people who are under legal age or lack the mental capacity to consent to marry may be able to have their marriage annulled. A marriage can also be annulled on grounds of fraud. Finally, a marriage can be annulled on the grounds of incest or impotency. However, the burden of proof for an annulment is greater than for a divorce.
It is not legal grounds for annulment, however, that the parties have not consummated the marriage through sexual relations with one another or that they have only been married for a short period of time.
